General; Term and Services
I, Advertiser, confirm the above information on this Advertising Agreement is complete and accurate and acknowledge that I have read and accept the Condo.com Advertising Terms and Conditions set forth on the Condo.com website and made a part of this Advertising Agreement.
This Agreement shall commence on the Effective Date and will continue in full force and effect for the agreed upon initial term (the "Term"). The marketing period shall begin when the Advertiser's building has been curated and the marketing campaign has been activated.
The Agreement will automatically renew month-to-month after the initial Term, until cancelled.
The Agreement may only be cancelled by providing five (5) day advance written email notice sent to support@condo.com. All cancellations shall be effective upon receipt so long as received within 5-days of any renewal period.
The building marketing services contracted for with Condo.com shall commence when the building has been curated and the marketing campaign has been activated. The Building Expert marketing program includes a suite of online and offline services. Monthly marketing charges are not tied to a specific program component (i.e. post card mailings and delivery), but rather the entire suite of services. In the event Advertiser does not select and approve a post card for their marketing program within the prescribed time period, Condo.com may select a postcard to be used on Advertiser's behalf. Failure of the Advertiser to complete or approve a postcard for mailing as part of the program does not entitle Advertiser to any refund related to the postcard mailing component of the program. The terms herein reflect the marketing services to be provided and associated contract terms and supersede any and all other written or verbal communication between Advertiser and Condo.com. Notwithstanding the foregoing, in the event Advertiser requests to swap buildings after this Advertising Agreement has been approved, Condo.com may rely on an email from the Advertiser to change the building(s) from what is set forth above, to the newly requested building(s). All other terms shall remain in full force and effect and only the buildings selected will be changed.
Refunds, Cancellations and Termination
There are no refunds for services provided. Services include account set-up and online and offline marketing of the Building Expert. In the first month of service, Condo.com spends considerable time and effort setting up the account, activating the online campaign and producing and mailing post cards or The Building Times⢠to building residents on the Advertiser's behalf. In the event of quarterly or annual pre-payment, refunds will be provided on a case-by-case basis for services to be provided in future months but not yet rendered. In the event of failure after five (5) attempts to process payment, your account and advertising program will be suspended and your leads, postcards and building reports will be paused and branding will be removed from the website. If billing failure continues for another five (5) attempts, your account will be terminated and your building will be made available for purchase in our system by other agents in cue. Please note that once an account has been terminated, we are not able to guarantee the building will be available. All terminated accounts will require a reactivation fee in order to restore services.
Advertisers that cancel their building marketing services must send an email to support@condo.com at least five (5) days prior to any renewal period. All cancellations that take place prior to the end of the Term are subject to a one-month cancellation fee. Advertisers shall be responsible for the current month of service and the cancellation fee, but will not be charged for additional monthly services following the date of cancellation.
Advertiser hereby agrees that the prevailing party shall have the right to collect from the other party its costs and necessary disbursements and attorney's fees incurred in enforcing this Advertising Agreement and shall be personally liable for the collection of such fees.
