I, Advertiser, confirm the information provided is complete and accurate and acknowledge
that I have read and accept the Condo.com
Advertising Terms and Conditions set forth on the Condo.com
website and made a part of this Advertising Agreement (the “Agreement”). This Agreement
shall commence on the date of product purchase and will continue in full force and effect
for the selected initial term (the "Term"). The marketing period shall begin when the
Advertiser's building has been curated and the marketing campaign has been activated. The
Agreement will automatically renew month-to-month after the initial Term, until cancelled.
The Agreement may only be cancelled by providing five (5) day advance written email notice
sent to firstname.lastname@example.org. All cancellations shall be effective upon receipt so long as
received within 5-days of any renewal period. In the event Advertiser requests to swap
buildings after the Agreement has been submitted, Condo.com may rely on an email from the
Advertiser to change the building to a newly requested building. All other terms shall
remain in full force and effect and only the building selected will be changed.
Refunds, Cancellations and Termination
There are no refunds for services contracted for pursuant to this Agreement. Services include account set-up and online and offline marketing of the Building Expert product. Condo.com spends considerable time and effort setting up the Advertiser account, activating the online campaign and producing and mailing post cards or The Building Times to building residents if applicable. In the event of cancellation prior to completing the advertising term, Advertiser shall only be entitled to a credit for unused services. Such credit can be used for marketing services offered by the Company at the time of cancellation, including a “swap" to another available building of the Advertiser’s choice. In the event of failure after five (5) attempts to process payment, your account and advertising program will be suspended and your leads, postcards and building reports will be paused and branding will be removed from the website. If billing failure continues for another five (5) attempts, your account will be terminated and your building will be made available for purchase in our system by other agents in cue. Please note that once an account has been terminated, we are not able to guarantee the building will be available. All terminated accounts will require a reactivation fee in order to restore services.
Advertisers that cancel their building marketing services must send an email to
email@example.com at least five (5) days prior to any renewal period. All cancellations that
take place prior to the end of the Term are subject to a one-month cancellation fee.
Advertisers shall be responsible for the current month of service and the cancellation fee,
but will not be charged for additional monthly services following the date of cancellation.
Advertiser hereby agrees that the prevailing party shall have the right to collect from the
other party its costs and necessary disbursements and attorney's fees incurred in enforcing
this Agreement and shall be personally liable for the collection of such fees.
